Cape Town – The uMkhonto weSizwe Party (MKP) has filed an urgent application to the Gauteng High Court seeking a declaration that the Judicial Service Commission’s (JSC) decision to proceed with next week’s interviews for judges is unconstitutional.
Last week, the Western Cape High Court issued an interdict preventing John Hlophe, the impeached Judge President of the Western Cape, from taking part in the interviews until the review of the National Assembly’s decision to appoint him to the JSC is concluded.
MKP aims to delay the process until legal issues surrounding Hlophe are resolved.

MKP argues that the interviews, which are meant to find Hlophe’s replacement, should not proceed without his involvement.
“Any decision to proceed with the JSC under its current composition would likely trigger further legal challenges and raise serious concerns about the legitimacy of any appointments made by an improperly constituted body,” said the MK party.
The case will be heard on Friday in Johannesburg.
