Cape Town – Jabulani Khumalo, the founder of the MK Party, has lost his bid to be reinstated as the party leader after the Electoral Court dismissed his case with costs.
Khumalo had challenged the Electoral Commission of South Africa’s (IEC) recognition of former President Jacob Zuma as MKP leader.
He filed an urgent application in May to overturn this decision and reinstate himself as the party president.

The court ruled that Khumalo’s application was an abuse of the judicial process and issued a punitive costs order against him.
“For all the above reasons, the application also constitutes an abuse of this Court’s process and a waste of its judicial economy and the opposing respondents’ resources.
“They have incurred legal costs opposing an application that should not have seen the light of day. It would be unfair to leave the respondents out of pocket under these circumstances,” the court said.
He was expelled from the party in April as part of a “cleansing” process.
Zuma has since replaced him as the leader of MKP.
