The case against Duduzile Zuma-Sambudla has been moved to the KwaZulu-Natal High Court in Durban, where she is scheduled to appear on 20 March.
Delivering his ruling, Magistrate Irfaan Khalil said that the affidavit from the Investigating Officer does not indicate any risk in granting her bail.
Khalil further noted that there is no justification for imposing bail conditions, adding that exceptional circumstances warrant her release.
“For this offense, it should be something out of the ordinary or exceptional. I am also struck by the state, which has no objection to your release on bail.
“I have considered all of your favourable circumstances and the state not opposing bail. I believe there are exceptional circumstances,” says Magistrate Irfaan Khalil.

Duduzile Zuma-Sambudla turns herself in as terrorism charges loom
Duduzile Zuma-Sambudla, the daughter of former president Jacob Zuma and a member of the uMkhonto weSizwe (MK) party, has voluntarily surrendered to the Durban Central police station.
She was accompanied by her lawyer, advocate Dali Mpofu.
Zuma-Sambudla is scheduled to appear in the Durban Magistrate’s Court on Thursday.

Police brace for large crowds as Zuma’s daughter appears in court on terrorism charges
Cape Town – Police are on high alert as the MK Party mobilises support for Duduzile Zuma-Sambudla, daughter of former president Jacob Zuma, who is appearing in the Durban Magistrate’s Court on Thursday.
She faces charges under the Protection of Constitutional Democracy against Terrorist and Related Activities Act (POCDATARA) for allegedly inciting the July 2021 riots, which led to 353 deaths.
The Hawks confirmed her arrest after a thorough investigation, while police expect large crowds at the court, Times Live reported.
The MK Party has urged supporters to attend or show solidarity in their regions.

Police spokesperson Colonel Robert Netshiunda said that authorities were prepared to oversee the situation and anticipated a large turnout of supporters.
“This is not the first court case to attract large crowds. But we are well prepared,” said Netshiunda, according to the report.
Zuma-Sambudla, who actively posted tweets during the unrest, previously anticipated her arrest.

The 2021 riots caused R50bn in damages, affecting 40,000 businesses and 150,000 jobs. The South African Human Rights Commission found no direct link between the violence and Zuma’s incarceration.
The Hawks have arrested 69 people in connection with the unrest, securing one conviction so far.
