Cape Town – The Equality Court, sitting at the Johannesburg High Court, has reportedly ruled in favour of Economic Freedom Fighters (EFF) leader Julius Malema and Member of Parliament (MP) Mbuyiseni Ndlozi in the “Shoot the Boer” case.
According to Sunday World, the two were taken to court by lobby group AfriFroum for singing the struggle song Dubul’ibhulu, which loosely translates to “kill the boer”, during the murder case of Brendin Horner, who was strangled to death on the farm he managed.
During the trial, AfriForum claimed that the song was hate speech.
Malema, on the other hand, stated that the song was taken out of context and that it is part of the country’s heritage, not a command.

According to The Citizen, Judge Edwin Molahlehi issued his decision on Thursday morning.
Molahlehi said that AfriForum failed to demonstrate that the EFF contravened the provisions of the Equality Act by singing the song.
He dismissed the lobby group’s application with costs.
“They have also failed to show that the merits in this song could reasonably be construed to demostrate a clear intention to harm or incite harm and propagate hatred,” said Molahlehi, as quoted by the report.
