Cape Town – The Durban magistrate’s court has postponed Durban businessman Thoshan Panday’s tax fraud case to October 4 to investigate his absence from court.
Despite Panday’s legal team presenting a medical certificate stating he is hospitalised, the magistrate ordered an inquiry, subpoenaing both the head of Westville Prison and the doctor responsible for his care to explain why the court and state were not informed.

“Despite a medical certificate being produced by his legal representative and handed in to the record indicating Panday is admitted in a private hospital in Durban, the magistrate deemed it befitting for the head of prison and the admitting doctor where he is allegedly kept for medical attention be subpoenaed to account for his absence and for not informing the court and the state,” said the spokesperson for the Investigating Directorate Against Corruption,” The Citizen quoted spokesperson for the Investigating Directorate Against Corruption (IDAC) Henry Mamothame as saying.
Panday, who was denied bail earlier in September, was scheduled to have his case transferred to the Durban high court, according to Times Live.
The state requested an extension of his detention.
“The state requested a further detention warrant to be issued to extend his detention in his absence,” said Mamothame.
