Cape Town – The Supreme Court of Appeal (SCA) has rejected Home Affairs Minister Aaron Motsoaledi’s application to appeal a high court ruling that deemed his decision to terminate the Zimbabwean Exemption Permit (ZEP) programme unlawful.
The Gauteng High Court had earlier declared Motsoaledi’s termination decision unconstitutional and ordered a fair public participation process.
The SCA found no reasonable prospects of success in an appeal.

The ZEP, which has allowed Zimbabweans to live, work, and study in South Africa, was extended until December 31, 2023, but the recent SCA decision upholds the high court’s judgment unless appealed to the Constitutional Court.
In a statement, the Helen Suzman Foundation welcomed the appellate court’s decision.
“The SCA’s decision in this regard means that the Pretoria High Court’s judgement still stands, unless the matter is referred to the Constitutional Court,” the foundation said.
