Cape Town – Former Public Protector Busisiwe Mkhwebane is taking legal action to claim her R10-million gratuity, challenging the decision of the current Public Protector’s office not to pay her.
According to The Citizen, Mkhwebane alleges she’s entitled to the gratuity despite her impeachment just before her term ended.
She argues that the delay in payment violates employment laws and her constitutional rights.
The application lodged on 1 March 2024 seeks for urgent relief to:
1. Declare unconstitutionality and invalidity of certain conditions and seek just and equitable remedy for the payment of relevant gratuity.

Mkhwebane also highlights a history of alleged malicious conduct and seeks relief including a court order for the gratuity to be paid within 30 days.
She will present her case in the Gauteng High Court in Pretoria.
