Cape Town – Thabiso Thobane, the instructing attorney of advocate Malesela Teffo reportedly said on Thursday that he will lay a complaint to the Legal Practice Council against Kelly Khumalo’s lawyer, Magdalene Moonsamy for allegedly defeating the ends of justice.
This was after Moonsamy accused Malesela Teffo, the defence lawyer for four of the accused men of “character assassination and defaming her client”.
According to News24, Teffo dropped the bombshell in the Gauteng High Court in Pretoria on Wednesday, saying that an eyewitness was set to testify that Khumalo shot Meyiwa by mistake.
“I put it to you Mr Mosia that a witness, not just a witness but an eyewitness will testify that Senzo Robert Meyiwa was allegedly shot by Nonhlanhla Kelly Khumalo by mistake, as it is alleged.
“The same eyewitness will further testify that the firearm used to shoot Senzo Robert Meyiwa by Kelly Khumalo came with Longwe Twala and the firearm is a revolver,” said Advocate Teffo.

The Citizen reported that Moonsamy was exploring their options regarding Teffo’s allegations about the eyewitness and the murder weapon used in the murder of Meyiwa.
“There is no greater moment than now with such an allegation, vexatious as it is, premature as it is to question an investigating officer regarding an eyewitness who will say this. It is not probable,” the report quoted Moonsamy as saying.
Thobane did not take kindly to the remarks made by Moonsamy to the media.
He said that legal practitioners cannot go and argue in the media about an ongoing case, Sunday World reported.
Thabane viewed Moonsamy’s action as an attempt to threaten the witnesses.
“What Moonsamy did is not right. Legal practitioners cannot go and argue in the media and do all these things. It is unethical and it deserves the attention of the LPC. Furthermore, whatever action she wants to take is an attempt to threaten our witnesses. It will put witnesses in a bad position and they might not even come to testify. Whatever she is saying, is tantamount to defeating the ends of justice.

“Remember, this issue is still in court. I am not going to comment a lot about it. We said we will call a witness. It is not advocate Teffo (making the allegation) we said we will call a witness. When she comes out saying that the witness will pull back,” said Thobane as quoted by the report.
Meyiwa was shot dead at Kelly’s home in Vosloorus, Gauteng on 26 October 2014.
In 2020, Muzikawukhulelwa S’Tembu Sibiya, Bongani Sandiso Ntanzi, Mthobisi Prince Mncube, Mthokoziseni Ziphozonke Maphisa, and Fisokuhle Ntuli were arrested.
They were charged with murder, attempted murder, armed robbery, and illegal possession of firearms and ammunition.
All of them pleaded not guilty to the murder of Meyiwa.
The trial continues.
