Cape Town — The Judicial Conduct Committee (JCC) has recommended that the complaint by impeached judge John Hlophe against former Chief Justice Mogoeng Mogoeng be probed further.
This comes after Hlophe’s 2020 complaint against Mogoeng where he alleged that the former Chief Justice had conducted himself in an improper and unlawful manner in the way he handled the complaint against him by Deputy Judge President, Patricia Goliath, SABC News reported.
Hlophe alleged that Mogoeng had a private conversation with Goliath in his absence and thereafter he had presided over the same allegations. His subsequent counter-complaint was inconsistent with his oath of office.
Mogoeng denies the allegations by the JCC said it considered that “the complaint will, if established prima facie, indicated gross misconduct on the part of the former Chief Justice that may be seen as bringing the judiciary into disrepute.”
The JCC recommended to the JSC that the complaint be investigated and reported upon a tribunal.

According to EWN, this could mean that Mogoeng Mogoeng could face a possible impeachment if the investigation finds the allegations to be true.
Mogoeng said Hlophe had not produced any evidence to support his allegations and said his meeting with Goliath was not a secret and was held in the normal course of executing his judicial leadership responsibilities.
The committee, led by Chief Justice Mandisa Maya, said it had to consider whether, if established, the complaint against Mogoeng indicates incapacity, gross incompetence, or gross misconduct on his part. It said that the Judicial Service Tribunal was the only forum that had the jurisdiction to investigate such complaints.
