Cape Town – The Mahikeng High Court reportedly annulled the auction of a R1.5 million house, ruling it was conducted unfairly.
The property, part of a divorce settlement, was sold at auction for just R1,000 to the ex-wife’s lawyer, who bid on her behalf, reports said.
According to Times Live, the ex-husband claimed he was unaware of the auction’s true location, expecting it to be at the property, and discovered too late it had been held at the sheriff’s office.
He argued the process was manipulated to benefit his ex-wife.
The court found the auction process inequitable, noting the wife had previously valued the property higher, proposing a buyout of R700,000 for her share.
Judge Ronald Deon Hendricks deemed the sale unfair, noting that the ex-husband stood to gain only R500 from the transaction, IOL reported.
Consequently, the court nullified the sale and barred the ex-wife from transferring the property into her name.
Additionally, she was ordered to cover the costs of the application.
