Cape Town – The ANC has invited dissatisfied members in Gauteng and KwaZulu-Natal (KZN) to challenge its decision to reconfigure provincial leadership in court if they wish.
The move follows the party’s poor performance in the May 2024 elections, where both provinces failed to secure a majority.
Secretary-General Fikile Mbalula said that the decision was made by the ANC’s top leadership and is aligned with the party’s constitution.
While the decision cannot be appealed internally, members are free to pursue legal action, with the NEC prepared to defend its actions in line with constitutional guidelines, Mbalula said during a press briefing on Monday.
“Can the PECs (provincial executive committee) appeal? Appeal what because this is an intervention by the highest structure, but because we are litigious other people can go to court and all of that, but we are implementing the constitution and should anyone try and go to court, it means we must act guided by the constitution.
“If we don’t follow the constitution they will go to court and challenge the decision, but the decision taken by the NEC (national executive committee) will be implemented in the framework of the (ANC’s) constitution because if you don’t do that, they will have grounds to challenge it in court,” he said.
