Supreme court to hear appeal on EFF’s ‘Kill the Boer’ chant

Cape Town – The Supreme Court of Appeal (SCA) will hear the appeal on September 4 against the Equality Court’s ruling that the singing of “Kill the Boer” by Julius Malema, leader of the EFF, was not hate speech, a report said on Tuesday.

According to Times Live, AfriForum, a civil rights organisation, is challenging the outcome after it lost its court bid to have Malema convicted of hate speech for singing the controversial song.

Malema had previously claimed that he changed the lyrics to “Kiss the Boer,” but he was heard singing the original version with EFF supporters at the party’s 10th-anniversary celebration, the report said.

AfriForum’s CEO, Kallie Kriel, sees the SCA case as part of their strategy to oppose Malema’s “racist and polarising” actions. They have appointed a prominent senior advocate to handle the matter and are prepared to go to the Constitutional Court if necessary.

“I believe AfriForum has a strong case against Malema, but should the South African courts find it is acceptable for Malema to sing songs that incite genocide against minorities, AfriForum will pursue the case internationally,” the report quoted Kriel as saying.

Meanwhile, South African-born tech billionaire Elon Musk has called for President Cyril Ramaphosa to take action, accusing the EFF party of “openly pushing for genocide of white people in South Africa”.
